Sick Leave Policy

1. PURPOSE

Globus (The Company) recognises that staff members may suffer from genuine short-term illness from time to time. It may even happen that a staff member contracts a more serious condition which is chronic, recurring or needs a longer recuperation period. This policy is designed to allow Employees the certainty of knowing the minimum extent to which the Company will continue to pay their salary or fixed wages.

However, the Globus Company, and individual teams within Production, Distribution, Sales and Admin are too small to absorb high levels of unplanned absences. It is a minimum standard required of all employees that they attend work on all normal work days and do their best to minimise unplanned absences of any sort. This Policy is also designed to let Employees know very clearly where the limits are and what consequences will flow from an individual failing to meet minimum attendance standards.

The use of sick leave when an individual is not ill will be viewed as a fundamental failure to meet minimum standards required of all Globus employees. The Company has usually accommodated other requirements for leave for personal business and other such needs upon the request of an employee. Employees should discuss special needs with their manager and not use sick leave for these purposes.

2. SCOPE

Applies to all employees of Globus Group Pty Ltd (Jupiter Pty Ltd) in Australia, other than casual employees.

This policy should be read in conjunction with the “Family Leave Policy.” Where the two policies are in conflict, this policy shall prevail, even if the provision in question is more recent in the Family Leave Policy.

3. ELIGIBILITY

The entitlement to use leave in accordance with this policy is subject to:

(i) The employee being employed by Globus as a full time salaried or wages employee (not probationary) for more than 3 months.

(ii) The person concerned being:

a) Genuinely ill to the extent that their attendance at work would worsen their condition and/or possibly lead to the spread of their illness to others in the workplace
b) Ill or incapacitated enough that they would not normally be out of their house, except to attend a medical appointment,

OR

c) Be required to attend a medical, dental, optical or such like appointment that is not possible or practicable for them to attend on a day or at a time when they are not required at work. Note pre-arranged visits to a G.P. or other service, such as optometry which are commonly available outside Globus working hours will not normally qualify for paid sick leave.

Other limitations on the availability of paid sick leave are that:

a. Probationary Employees or those with less than 3 months full time service (whichever is the greater period) will be normally NOT be allowed paid sick leave unless it is specifically stated otherwise in their contract of employment.

b. Where the individual concerned could or should have reasonably known of the medical condition that is requiring sick leave to be taken and did not declare it at the time of selection for employment by the Company, paid sick leave may not be granted.

c. The Employee has followed and continues to follow all reasonable requirements and directives of the Company in respect of sick leave policy and procedure.

d. There should be a positive balance of sick leave due. Sick leave in advance will not be allowed.

Where paid sick leave is not granted, or all sick leave balances have been exhausted, the Company shall offer the employee the option of taking any accrued balances of annual or long service leave or leave without pay. Except where the Company determines that there is a case of hardship occasioned directly as a result of the illness or injury causing the sick leave, the taking of annual leave or long service leave will not be allowed beyond the balances recorded on that employee’s pay record. (i.e. No leave in advance.)

Where paid sick leave is not available and all other leave balances have been exhausted, the Company may, at its sole discretion, either extend that employee paid special leave or leave without pay. This discretion is entirely the prerogative of the Management and Directors of Globus and the granting of such leave in any single instance cannot be taken to set a precedent for any other circumstances or in any other instance.

Should an employee remain on unpaid sick leave for a period greater than 4 weeks the Company shall have the right to consider that the employee has abandoned their position. Notices regarding the abandonment of employment shall be issued in writing to the employee’s last known address. The waiver of the Company’s right in any instance or for any period of time shall not constitute a permanent waiver and the Company shall always have the right to act on this clause at any time after 4 weeks have elapsed.

4. PROCEDURE

4.1. Every Employee is entitled to 10 days sick leave per year of service fully completed. All sick leave taken will be deducted from this entitlement to calculate the remaining balance due at any point in time. Sick leave may be allowed pro-rata for parts of years of service completed, at the discretion of the Company.

4.2. Unless there is a specific written contract with an individual that has been signed by both that individual and the Group General Manager of the Company, there is no entitlement to any untaken portion of sick leave on termination of cessation of employment.

4.3. If it is not practical for the employee to give prior notice of sick leave being required, the employee shall notify their manager at the earliest opportunity on EACH day of absence. The “earliest opportunity” shall mean no later than one hour after the normal work commencement time for that individual. The requirement to notify is a minimum standard required of any employee and failure to notify may lead to a formal warning being issued.

4.4. For pre-arranged medical, dental or other such procedures, an employee shall wherever practical, give their supervisor or manager notice prior to the taking of sick leave, the reasons for taking such leave (particularly related to why the appointment cannot be made for a period outside work time) and the estimated length of the absence.

4.5. Notice is to be given formally by completing a sick leave request form.

4.6. For all absences longer than one day, it is required that Employees will obtain a medical certificate issued during their period of absence.

4.7. Where an individual has 3 or more single day absences in any 12 month period, Globus will require a medical certificate for every absence, including single days, after that for at least the next 24 months or until a steady record of attendance is re-established.
